1. Introduction and Acceptance of Terms

Welcome to Heritage Community Development Foundation (the “Organisation,” “we,” “us,” or “our”). The Organisation is a non-profit entity operating under the laws of the Federal Republic of Nigeria, dedicated to helping the youth re-evaluate themselves, engage in self-renewal and gain confidence, leadership skills and integrity.  We will facilitate training in civic awareness, entrepreneurial skills, self-confidence and leadership skills. We will promote and facilitate diaspora investment in local projects.

These Terms and Conditions of Use (“Terms”) govern your access to and use of our website, located at[https://h-cdf.org (the “Website”), and any content, functionality, and services offered on or through the Website.

By accessing, browsing, or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (if separate). If you do not agree to these Terms, you must not use or access the Website.

The Organisation does not offer legal, financial, or professional advice through this Website. 3.1 Minimum Age: You affirm that you are either 16 years of age or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties outlined in these Terms, and to abide by and comply with these Terms.

3.2 Access: We reserve the right to withdraw or amend the Website, and any service or material we provide on the Website, in our sole discretion, without notice. We will not be liable if, for any reason, all or any part of the Website is unavailable at any time or for any period.

4. Intellectual Property Rights

4.1 Organisation Content: The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Organization, its licensors, or other providers of such material and are protected by Nigerian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 Limited License to User: You are granted a non-exclusive, non-transferable, revocable license to access and use the Website strictly in accordance with these Terms for your personal, non-commercial use related to supporting the Organisation’s mission. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as standard web browser functionality permits.

4.3 Trademarks: The Organisation’s name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Organisation or its affiliates or licensors. You must not use such marks without the prior written permission of the Organisation.

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

6. User Submissions and Donations

6.1 User Content: If the Website allows you to post comments, feedback, or other content (“User Content”), you grant the Organisation a perpetual, irrevocable, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, translate, publish, and distribute your User Content in any medium and for any purpose related to the Organisation’s mission. You represent and warrant that you own or control all rights in and to the User Content and have the right to grant the license granted above.

6.2 Donations:

  • All donations made through the Website are voluntary and non-refundable unless otherwise required by Nigerian law or specifically stated in a separate written agreement with the Organisation.
  • We use third-party payment processors to handle donations. By donating, you agree to the terms and conditions of that payment processor.
  • The Organisation makes every effort to ensure the security of your payment information, but is not liable for data breaches that occur on the payment processor’s system.

12. Governing Law and Jurisdiction

These Terms and your use of the Website shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the courts of Nigeria, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
